First, here is the latest on today’s votes. The U.S. Senate failed to pass the motion to proceed on S. 1140 by 57 yeas to 41 nays. We needed 60 votes for passage. Senators Manchin (WV), McCaskill (MO), Heitkamp (ND), and Donnelly (IN) were the Democrats voting for S. 1140. Senators Hatch (UT) and Brown (MA) did not vote.
The Senate next pivoted to S.J. Res. 22, the Ernst Congressional Review Act (CRA) resolution to disapprove the WOTUS rule. 50 votes were needed on the motion to proceed and the final vote tally was 55 yeas and 43 nays. Now there is up to 10 hours of debate on the Senate floor equally divided between the two parties. We expect the measure to pass.
President Obama has said he will veto S.J. Res. 22 if it comes to his desk. It is unlikely there will be 67 votes to override his veto. So we will turn our attention back to the Appropriations process to work on including a WOTUS rider in a final government spending bill. We will also continue to watch the courts to see what becomes of the rule in their hands.
